(Thesis, Master of Laws (LLM)). The University of Waikato, Hamilton, New Zealand. There are indications that the rule of law may be being forgotten, ignored or breached within the criminal justice system, producing what appear to be unfair outcomes which further marginalise particular sectors of society. An examination of Pre-Sentence Reports, as one small but important part of the criminal justice process, and the sentencing process in particular, will assist in testing and establishing whether assumptions about inequality in the sentencing process are justified.application/pdfenAll items in Research Commons are provided for private study and research purposes and are protected by copyright with all rights reserved unless otherwise indicated.Pre-sentence reportTauranga CourtMaori defendantsDefence counselRule of lawSocial justiceConflict theoryMarxRawlsMandelPSRPSRsProbationSentences (Criminal procedure) -- New ZealandPre-sentence investigation reports -- New ZealandRule of law -- New ZealandSocial justice -- New ZealandMaori (New Zealand people) -- Legal status, laws, etc. -- New ZealandProbation -- New ZealandDoes the pre-sentence report carry weight in the sentencing process and does it uphold the principles of the rule of law?Thesis2021-05-14TureTure o te Kāwanatanga
